Acceptance of Terms

By downloading, installing, or using BrainSpark ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

Description of Service

BrainSpark is a general knowledge learning application that provides quiz sessions, spaced repetition learning, and educational content across various subjects. The App is provided for personal, non-commercial educational use.

User Responsibilities

You must be at least 4 years old to use this App (or the minimum age required in your jurisdiction).
You are responsible for maintaining the security of your device and any data stored within the App.
You agree not to use the App for any unlawful or prohibited purpose.

In-App Purchases and Subscriptions

BrainSpark offers optional in-app purchases:

BrainSpark Pro (Yearly): An auto-renewable subscription that provides unlimited sessions, all subjects, and premium features.
BrainSpark Pro (Lifetime): A one-time purchase that permanently unlocks all Pro features.

Subscription terms:

Payment will be charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
You can manage and cancel your subscriptions by going to your App Store account settings after purchase.
Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

Content and Intellectual Property

Quiz questions in BrainSpark are sourced from:

Open Trivia Database: Licensed under Creative Commons Attribution-ShareAlike 4.0 International License.
Wikipedia: Content used under Creative Commons Attribution-ShareAlike License.
REST Countries: Publicly available country data.
NASA: Public domain imagery and content.
Bundled content: Original questions created for BrainSpark.

The BrainSpark app design, branding, and original content are the intellectual property of Somesh Arora.

Disclaimers

The App is provided "as is" without warranties of any kind, either express or implied.
We do not guarantee the accuracy, completeness, or timeliness of any content provided through the App.
Educational content is for general knowledge purposes only and should not be relied upon as professional advice.
We are not responsible for any content provided by third-party APIs.

Limitation of Liability

To the maximum extent permitted by applicable law, Somesh Arora shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the App.

Data Deletion

You can delete all your data at any time by going to Settings > Delete All Data within the App. This will permanently erase all your progress, session history, and preferences.

Changes to Terms

We reserve the right to modify these Terms of Use at any time. Changes will be effective immediately upon posting to this page. Your continued use of the App after changes constitutes acceptance of the modified terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
